THE COMMON COUNCIL OF THE CITY OF NEW RICHMOND DOES ORDAIN AS FOLLOWS:
Section 105-33(b) shall be amended to read as follows:
Sec. 105-33 Violations.
(1) If an inspection reveals a noncompliance with this article or the Uniform Dwelling Code, the Department of Building Inspection shall notify the applicant and the owner, in writing, of the violation to be corrected. Except as otherwise provided, any person violating any of the terms of this article or the Uniform Dwelling Code, shall be subject to a forfeiture of not less than one hundred dollars ($100) nor more than two hundred dollars ($200), together with the costs of prosecution; provided that for any violation(s) of any condition in this article or the Uniform Dwelling Code which can be corrected by modification or repair, failure to correct or rectify such defect within a reasonable time, as determined by the Department of Building Inspection, shall constitute a separate violation for each day in which the violation exists, and be subject to penalties provided herein.
(2) If, after written notification, the violation is not corrected within a reasonable time, as determined by the Department of Building Inspection, a stop-work order may be served on the owner or his/her representative and a copy thereof shall be posted at the construction site. Such stop-work order shall not be removed except by written notice of the Department of Building Inspection after satisfactory evidence has been supplied that the cited violation has been corrected.
(3) If any construction or work governed by the provisions of this article or the Uniform Dwelling Code is commenced prior to the issuance of a permit, double fees shall be charged.
This ordinance shall take effect immediately upon passage and publication as provided by law.
