Judge to decide if Superior man will get new trial for murder of Leah Gustafson
A Douglas County judge says he will decide by the end of next month whether Jason Borelli gets a new trial.
Borelli is serving a life sentence for his conviction in the murder of Leah Gustafson two years ago.
A motion for a new trial has been filed claiming ineffective counsel.
The judge in Superior has already heard more than 300 hours of testimony in the case calling for that retrial.
Gustafson lived across the street from Borelli. He was found guilty of choking, beating and stabbing her to death using a sword as a weapon.
He'd tried an insanity defense, but the jury rejected that argument.
The original prosecutor says it was a straightforward case and the verdict and sentence should stand.
