REGULAR COUNCIL MEETING, April 13, 2009 7:00 P.M.

The meeting was opened by announcing that this was an open meeting of the Common Council. Notice of this meeting was given to the public at least 24 hours in advance of the meeting by forwarding the complete agenda to the official City newspaper, the New Richmond News, and to all news media who have requested the same as well as posting. Copies of the complete agenda were available for inspection at the City Clerk's office. Anyone desiring information as to forthcoming meetings should contact the City Clerk's office.

Roll call was taken.

Members Present: Mayor Schnitzler, Alderman Horne, Johnston, Hansen, Volkert, and Zajkowski.

Members Absent: Alderman Dale-Wozniak and Student Representatives Megan Elkin and Ariel Berres-Green.

The Pledge of Allegiance was recited.

Alderman Johnston moved to adopt the agenda as amended, seconded by Alderman Horne and carried.

Alderman Zajkowski moved to waive the reading of the minutes of the previous Regular Council meeting, March 9, 2009 and approve them as presented, seconded by Alderman Johnston and carried.

Request for Extension of Premise

Alderman Horne moved to approve the request from Kellaher's Bar for an extension of premise for their Class B Liquor License to include an area in the parking lot that is clearly defined and controlled for July 10-12, 2009, seconded by Alderman Volkert and carried.

Request for Amplified Music

Alderman Volkert moved to approve a request from Kellaher's Bar to have outdoor amplified music until midnight on July 10-11, 2009, seconded by Alderman Johnston and carried.

Application for Street Use Permit

Alderman Volkert moved to approve the application from St. Mary's School for a Street Use Permit for Wisconsin Drive, St. Croix Avenue, and Richmond Way on May 30, 2009 from 9 a.m. to Noon, seconded by Alderman Hanson and carried.

Application for License to Serve

Alderman Horne moved to approve the application for License to Serve from Alanna L. Warner, New Richmond, seconded by Alderman Hansen and carried. Alderman Horne moved to deny the application for License to Serve from Kyle J. Wettig, Star Prairie, seconded by Alderman Johnston and carried.

Applications for Temporary Class B Beer License:

Alderman Zajkowski moved to approve the application for Temporary Class B Beer License from the New Richmond Miller's Baseball Team for May 10, 20, June 5, 12, 19, 20, 24, July 1, 3, 10, 15, 24, 31, and August 1, 2009, seconded by Alderman Johnston and carried.

Alderman Johnston moved to approve the application for Temporary Class B Beer License from Immaculate Conception Church for Mayfest on May 16-17, 2009, seconded by Alderman Hanson and carried.

WDOT American Recovery & Reinvestment Act

Bob Barbian stated that he will be submitting an application for two projects under the STP Urban Grant. The first project would be Fourth Street from Hwy 65 to Hwy 64 with the roadwork estimated at $985,000 and utility work estimated at $453,000. The second project would be the New Richmond Rail Trail on Dakota Avenue from Sixth Street to First Street with the estimated cost of $297,000. No Action was taken.

Resolution #040901 Stormwater

Alderman Johnston offered the following resolution and moved for its adoption:

RESOLUTION #040901

WHEREAS, City of New Richmond hereby requests financial assistance under s.281.65 or 281.66, Wis. Stats., and chs.NR 151, 153, and 155, Wis. Admin. Code, for the purpose of implementing measures to meet nonpoint source water pollution abatement needs in area-wide water quality management plans or with one or more components specified in s. 281.65 of 281.66, Wis. Stats.,

NOW, THEREFORE, BE IT RESOLVED, that City of New Richmond HEREBY AUTHORIZES Robert Barbian, Director of Planning & Development of the City of New Richmond, to act on its behalf to:

1. sign and submit a grant application

2. sign a grant agreement between the local government and the DNR

3. submit quarterly and final reports

4. request grant reimbursement

5. sign and submit an Environmental Hazard Assessment form (1800-001)

Motion was seconded by Alderman Hansen and carried.

Government Entities Network

Mayor Schnitzler appointed Alderman Horne and Zajkowski to be on the Government Entities Network along with himself and Dennis Horner. Alderman Johnston moved to confirm this appointment, seconded by Alderman Horne and carried.

Initiation of Annexation Petition for Richmond Way Extension

Alderman Horne moved to approve the notice of intent to circulate petition for annexation of territory to the City of New Richmond for property purchased for the East Richmond Way extension to 140th Street, seconded by Alderman Johnston and carried.

Lawsuit Update

Ron Siler, City Attorney, gave an update on the Wickenhauser Lawsuit. The Wichenhausers recently won their appeal to the Condemnation Commission, but our attorney is filing an appeal to the Circuit Court. St. Croix County Circuit Court recently overturned the decision made by the Board of Appeals to grant a variance to the Hockey Center to build another building on their property. Mark Maple had appealed the decision of the Board of Appeals.

Direct Seller's Permit

Mike Thole has requested to get a direct seller's permit to be able to have his ice cream truck in town during the summer months. Alderman Zajkowski moved to waive the fee and grant the permit for Mike Thole, seconded by Alderman Hansen and carried.

Street Committee Recommendations

The Street Committee recommended approving the Adopt-A-Road policy as presented by Dan Koski. Alderman Volkert moved to accept this recommendation, seconded by Alderman Johnston and carried. Alderman Hansen voted no.

The Street Committee recommended installing bike route signs on Dakota Avenue and have the Street Department paint the streets on Dakota Avenue from Sixth Street to First Street with the cost of $1,000, with the funds from TIF#9. Alderman Volkert moved to accept this recommendation, seconded by Alderman Hansen and carried.

Street Committee recommended denying the request to put slow children at play signs on Sequoia Lane and Nevada Avenue and have speed limit signs installed on these streets instead. Alderman Volkert moved to accept this recommendation, seconded by Alderman Zajkowski and carried.

Finance Committee Recommendations

The Finance Committee recommended approving the contract from PCM Global Solutions for $2,500 per month for 12-13 hours of work with TIF eligible expenses coming from TIF funds, otherwise the money will come from the General Fund. Alderman Zajkowski moved to accept this recommendation, seconded by Alderman Johnston and carried.

The Finance Committee recommended donating $300 to the New Richmond School Learning Service Day with $300 coming from the General Fund Park budget. Alderman Zajkowski moved to accept this recommendation, seconded by Alderman Johnston and carried.

The Finance Committee will look into paying off the YMCA note when they do the next bond issue to get a better interest rate.

The Finance Committee recommended paying the difference for Officer Schuette, while he serves on active duty in the National Guard, between the officer's pay and military pay, and to accrue sick and vacation time while he is on active duty. Alderman Zajkowski moved to accept this recommendation, seconded by Alderman Johnston and carried.

The Finance Committee recommended applying for a COPS grant to pay for an officer that will work with the schools for three years. The City has to keep the employee one year after the grant period is over and Mark Samelstad has drafted a memorandum of understanding with the school that would have the school pay 70% of the salary and benefits for the officer the 4th year of service. The MOU will be brought to the next School Board Meeting for approval. Alderman Zajkowski moved to accept this recommendation, seconded by Alderman Horne and carried.

The Community Service Officer has been selected and will be working from approximately Memorial Day until Labor Day.

Police Lieutenant Jerry Cody recently had heart surgery and will be off duty for a few months. Mark Samelstad has temporarily promoted Craig Yehlik to fill the duties of the Lieutenant. Mark requested to increase Craig's salary to $31.03 per hour to match the salary that Jerry Cody was receiving. The Finance Committee recommended increasing Craig Yehlik's pay to match Jerry Cody's for the time he will be filling in for him. Alderman Zajkowski moved to accept this recommendation, seconded by Alderman Johnston and carried.

Alderman Zajkowski moved to pay VO# 37741 thru VO# 37960 for $408,366.99 plus electronic transfers totaling $627,278.00, for a grand total of $1,035,644.99 with the funds coming from the following accounts:

General Fund $810,529.22

CDBG - Housing Grant 2,875.60

Health Insurance 2,818.17

Debt Service 9,701.79

Debt Service B Bonds 431.25

Capital Projects 25,478.65

Landfill Cleanup Project 88,604.11

TIF # 6 7,563.07

Motion was seconded by Alderman Johnston and carried.

Communications and Miscellaneous

Alderman Johnston stated that he has enjoyed his time as alderman and he wished Alderman Kirk Van Blaircom good luck in the future as Alderman for District 2. Mayor Schnitzler thanked Alderman Johnston for his years of service to the City of New Richmond.

Closed Session

Alderman Johnston moved to go into Closed Session per State Statute 19.85 (1)(c)(e) to discuss Economic Development Proposals; Negotiate Possible Purchase of Property at 750 North Knowles Avenue; Boundary Agreement - Star Prairie Township; and Personnel, seconded by Alderman Horne and carried.

Open Session

Alderman Horne moved to sell property to LWT as discussed in closed session, seconded by Alderman Volkert and carried.

Alderman Johnston moved to spend $8,000 for engineering a possible rail spur, seconded by Alderman Horne and carried.

Alderman Zajkowski moved to have the Property Committee discuss the purchase of property at 750 North Knowles Avenue, seconded by Alderman Horne and carried. Alderman Volkert voted no.

Alderman Johnston moved to adjourn the meeting, seconded by Alderman Horne and carried.
