Settlement reached in Dylan McHenry NLRB complaint
A settlement has been reached in Dylan McHenry's National Labor Relations Board (NLRB) case against Teamsters Local Union 974.
McHenry initially filed the charges through the National Right to Work Foundation this summer, alleging Teamsters Local Union 974 had refused to follow federal disclosure requirements and had taken money from his paychecks for its political action committee. At the time, McHenry was a New Brighton, Minn. journeyman technician at Ford. McHenry had resigned from union membership in April, but under Minnesota law he was still required to pay certain union fees.
However, workers who are not official union members are not required to pay dues or fees for political activities. McHenry alleged that Teamsters officials did not provide him with a complete list of where his required dues were being spent. He also alleged the union used some of his dues for their political action committee.
The settlement states that Teamsters Local Union 974 will post a copy of a notice at New Brighton Ford in New Brighton, Minn., addressed to workers and union members.
The notice will inform workers and union members that federal law gives them the right to be part of a union or choose not to be part of a union.
The notice further states that Teamsters Local 974 will not fail or refuse to provide information about the right to challenge the union's computation of the fair share portion of fees and dues. The union also promises to provide a breakdown by major expense categories of chargeable and non-chargeable expenses for the union's affiliates.
The notice will also be emailed to all Teamsters Local Union 974 members and all employees that work at New Brighton Ford.
The settlement also states that Teamsters Local Union 974 has already refunded McHenry for all non-chargeable expenses, which totaled $3.14.
NLRB representatives declined to comment on the case.
Anthony Riedel, National Right to Work representative, said the National Right to Work Foundation was pleased that a settlement was reached in the parts of McHenry's case that were pursued by the NLRB.
McHenry himself could not be reached for comment.
Tom Tweet, Teamster's Local 974 secretary-treasurer, said Teamsters doesn't agree 100 percent with the settlement, but will abide by it. "We'll post the notice as the NLRB requires us to," Tweet said.
