TOWN OF SOMERSET Town Board Meeting MInutes

Wednesday,

March 4, 2009

Chairman Schachtner called the meeting to order at 7:00 p.m. Present were Germain, Gunderson, Demulling, Plourde, and Schachtner. The Pledge of Allegiance was recited. Motion by Gunderson, seconded by Germain to approve the agenda. Motion carried. All members voted yes. No public input.

Clerk's & Treasurer's Report: Motion by Demulling, seconded by Plourde to approve the February 4th Minutes. Motion carried. All members voted yes. Motion by Plourde, seconded by Gunderson to approve the February Financial Report. Motion carried. All members voted yes.

Building Inspector's Report: Motion by Germain, seconded by Demulling to approve the February Building Inspector's Report. Motion carried. All members voted yes.

Animal Control Report: Motion by Demulling, seconded by Gunderson to approve the February Animal Control Report. Motion carried. All members voted yes.

Fire/Rescue Commission Report: 2009 total runs so far are 53 (Town=11, Village=25, St. Joseph=11, Mutual Aid=6); brush truck delivery expected in March, generator bids have been received, website is functional and insurance rates were reviewed and lowered. Motion by Germain, seconded by Plourde to approve the Fire/Rescue Commission Report. Motion carried. All members voted yes.

Transportation & Facilities Committee Report: Schachtner reported on upcoming road project involving moving intersection of 85th St. and 160th Avenue. Surveying estimates will be obtained for April 1st Town Board consideration, along with roof repair and exterior painting estimates. Road maintenance techniques of crack filling, flex patch and seal coating were discussed. Motion by Gunderson, seconded by Demulling to approve the Transportation & Facilities Committee Report. Motion carried. All members voted yes.

Parks & Rec Committee Report: Committee is working on request for donations from Park Fund application and park permit fees, citation, parking, and pay box ordinances. Motion by Germain, seconded by Demulling to approve the Parks & Rec Committee Report. Motion carried. All members voted yes.

Law Enforcement Contract with St. Croix County Sheriff: Plourde commented on adding "officer keep a log of activities" and a statement that if problems occur, "officer will contact Town liaison" under #3. Clarify if court time for deputy is a charge to the Town under #5. Discussion about ticketing, towing, annual permit and pay box.

Old Business: Plourde reported on research concerning ordinance codification. Companies host the ordinance and an annual fee is required for maintenance.

New Business - Asphalt Associates - Roger VanBeek: VanBeek presented a packet of their services. He introduced himself and his company and asked that the Town consider their services for road maintenance. Board consensus that crack filling, flex patch and cut/patch pricing will be obtained.

Mark Casey 435 - 172nd Avenue - Letter on Ditch Damage: Town Board reviewed letter with photos of ditch. 33' from center of road is Town road right-of-way. Motion by Gunderson, seconded by Plourde that road crew flip sod back, but since this is in the road right-of-way that is owned by the Town, no seeding will be done. Motion carried. All members voted yes. A letter will be sent to Casey.

Harold Rivard - Request for Refund of Taxes due to Assessor Error: Due to Bob Irwin's error, an over assessment for 2005, 2006 & 2007 occurred. 4.77 acres was attached to lot 2 which was 4 acres and it should have been attached to the 20.18 acres of ag. land and assessed as ag. 4.77 acres was assessed at the residential rate instead of the ag. rate for parcel #032-2047-60-250. Chimney Rock made the correction and the 2008 tax roll was correct. Motion by Plourde, seconded by Demulling to approve a refund for the 2007 tax year in the amount of $457.55 to Harold Rivard for the over assessment of parcel #032-2047-60-250 due to Irwin's error. Motion carried. All members voted yes.

Town Hall Rock Sign Garden: Motion by Gunderson, seconded by Germain to approve up to $250.00 for the Town Hall rock sign garden area. Motion carried. All members voted yes. Discussion on contacting Rivard Stone to get a base for rock sign to be raised up and placed on.

Chamber of Commerce Membership: Motion by Plourde, seconded by Demulling to join the Somerset Area Chamber of Commerce for 2009 at $100.00 due fee. Motion carried. All members voted yes.

Somerset Library - Use of Town Hall: Motion by Gunderson, seconded by Germain to approve the Somerset Library's use of the Town Hall for the walk/run benefit on Saturday, May 2. Motion carried. All members voted yes.

Meeting with Town of Star Prairie on 80th Street: Board consensus was to have Transportation & Facilities Committee meet with representatives from Town of Star Prairie to discuss 80th Street.

Planning Commission Report: Rauch reported on subdivision ordinance draft and feedback from County Technical Review Committee/Ellen Denzer. Sections 10, 11, 12 were revised.

Other Announcements: Water testing results meeting March 12, 7:00 p.m. at Town Hall.

Meeting adjourned at 9:00 p.m.
