Pursuant to due call and notice thereof, posted 9/29/2008, the Star Prairie Village Board met on 10/1/2008 at 7:05 p.m. in the Community Center. The meeting was called to order by President Greg Gibson. Roll call. Members Present: Trustees Rob Berger, Mick Maxon, Andrew Marrier and President Greg Gibson. Absent: Trustee Bruce Johnson. Also present attorney Tim Scott and engineer Jim DeBenedet. Trustee Berger moved to adopt the agenda as presented seconded by Trustee Maxon. Motion carried.

PUBLIC HEARING

President Gibson introduced Village engineer Jim DeBenedet, Stevens Engineers, who has been working with the Village on the proposed Comprehensive Plan. The plan will guide the growth and development of the Village over the next twenty years. President Gibson asked for public comment. Village resident Janet Knutson inquired about areas on the existing land use and future land use maps and other technical corrections to the plan. President Gibson closed the public hearing.

Trustee Marrier moved to approve the minutes of September 3, 2008 and September 16, 2008 as presented seconded by Trustee Maxon. Motion carried. Trustee Berger moved to approve the August 2008 Treasurer's Report seconded by Trustee Marrier. Motion carried. Trustee Maxon moved to approve the disbursements ($42,036.76) as presented seconded by Trustee Berger. Roll call vote, all members voted yes. Motion carried.

REPORTS

Police - Chief Richard submitted the September 2008 Police Activity report (on file).

Maintenance - Brody Larson presented the September 2008 Maintenance report (on file). There was discussion on water system valve shut off for the well house to the tower, additional valve boxes and adding an additional hydrant to make the well meter testable on site. Jim DeBenedet, Stevens Engineers will work with Brody to submit the necessary plans and specifications to the Department of Natural Resources for the water main extension approval.

NEW BUSINESS

Bank Services Proposals

Kathy Graham and Julie Freeborn, with Bremer Bank gave a short presentation and presented a proposal to the Board. Rick Prokash, First National Bank of River Falls presented an updated proposal to the Board. Following discussion of pros and cons of the banking services offered President Gibson recommended taking additional time to look over the proposals. Trustee Marrier moved to table the bank services proposals until a later date seconded by Trustee Maxon. Roll call vote, all members voted yes. Motion carried.

Ordinance to Adopt the Comprehensive Plan

Trustee Marrier moved to adopt An Ordinance to Adopt the Comprehensive Plan of the Village of Star Prairie with technical corrections seconded by Trustee Berger. Roll call vote, all members voted yes. Motion carried.

An Ordinance to Adopt the Comprehensive Plan of the Village of Star Prairie, St. Croix County, Wisconsin

The Village Board of the Village of Star Prairie, Wisconsin, do ordain as follows:

Section 1. Pursuant to section 62.23(2) and (3) of the Wisconsin Statutes, the Village of Star Prairie, is authorized to prepare and adopt a comprehensive plan as defined in section 66.1001(1)(a) and 66.1001(2) of the Wisconsin Statutes.

Section 2. The Village Board of the Village of Star Prairie, Wisconsin, has adopted written procedures designed to foster public participation in every stage of the preparation of a comprehensive plan as required by section 66.1001(4)(a) of the Wisconsin Statutes. Section 3. The plan commission of the Village of Star Prairie, by a majority vote of the entire commission recorded in its official minutes, has adopted a resolution recommending to the Village Board the adoption of the document entitled "Village of Star Prairie Comprehensive Plan: 2008-2028," containing all of the elements specified in section 66.1001(2) of the Wisconsin Statutes.

Section 4. The Village of Star Prairie has held a public hearing at its Village Board meeting on October 1, 2008 on this ordinance, in compliance with the requirements of section 66.1001(4)(d) of the Wisconsin Statutes.

Section 5. The Village Board of the Village of Star Prairie, Wisconsin, does, by enactment of this ordinance, formally adopt the document entitled, "Village of Star Prairie Comprehensive Plan: 2008-2028," pursuant to section 66.1001(4)(c) of the Wisconsin Statutes.

Section 6. This ordinance shall take effect upon passage by a majority vote of the members of the Village Board.

Resolution Addressing Emergency Repairs to a Village Water Main

Trustee Marrier moved to adopt Resolution Number 05-2008 Addressing Emergency Repairs to a Village Water Main seconded by Trustee Maxon. Roll call vote, all members voted yes. Motion carried.

RESOLUTION NO. 05-2008

Village of Star Prairie

A Resolution Addressing Emergency Repairs to a

Village Water Main

WHEREAS, Sections 61.55 of the Wisconsin Statutes specifies procedural requirements which must be followed in the letting of contracts for public construction; and

WHEREAS, Sections 61.55 of the Wisconsin Statutes also creates an exception to those procedural requirements for the repair and reconstruction of public facilities when damage or threatened damage thereto creates an emergency in which the public health or welfare of the village is endangered; and

WHEREAS, Sections 61.55 of the Wisconsin Statutes further specifies that any such emergency situation shall be determined by resolution of the Village Board; and

WHEREAS, the Village Board has recently been informed that several of the brackets holding the village water main in place under the County Highway "M" bridge over the Apple River are damaged or broken; and

WHEREAS, Stevens Engineers, the Village Engineer, has informed the Village Board that the damaged or broken brackets could result in a break in the water main; and

WHEREAS, Given the age of the pipes in that portion of the Village's water main system, the availability of compatible parts to repair any such break is uncertain, meaning that the repair of any break could be delayed for a number of days as the necessary parts are located and the necessary repairs completed; and

WHEREAS, Breakage of the water main result in the loss of water service to a significant number of Village residents whose residences are serviced by that main; and

WHEREAS, Loss of water service to that portion of the Village would negatively affect the Village's ability to provide essential services, including fire protection services, to the affected residences.

THEREFORE, the Village Board of the Village of Star Prairie hereby determines that, pursuant to Wisconsin Statutes Section 61.55, the damaged and broken water main brackets endanger the public health and welfare of the residents of the Village and that such endangerment is sufficient to invoke the emergency exception to the procedural requirements for the letting of public contracts for the repair of public facilities contained in the Wisconsin Statutes. This emergency status shall continue to be in effect as to the referenced water main until the Village Board formally declares that such status no longer exists.

Water main under County Highway M Bridge

There was discussion on repairing the broken hanger and the misalignment of the watermain suspended on the CTH M Bridge and options for long term plans to replace the main that is suspended from the Bridge. Village engineer Jim DeBenedet will work with Brody on preparing plans for the watermain repair.

Star Prairie Municipal Court

Trustee Maxon moved to appoint Village of Star Prairie attorney Tim Scott to fill the position of Prosecutor for Star Prairie Municipal Court and Circuit Court matters seconded by Trustee Berger. Roll call vote, all members voted yes. Motion carried.

Purchase of trees

Trustee Marrier moved to purchase six (6) trees for River Island Park seconded by Trustee Berger. Motion carried.

Special Meeting date

Trustee Maxon moved to set a special meeting for October 13, 2008 at 6:00 p.m. to work on the 2009 Budget seconded by Trustee Berger. Motion carried.

Set/Change November Board Meeting date

Trustee Berger moved to change the November Board of Trustees meeting date to November 6, 2008 at 7:00 p.m. seconded by Trustee Maxon. Motion carried.

Public Comment - none

Closed Session

Trustee Maxon moved to go into closed session pursuant to Wis. Stat. §19.85(1)(e), deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session, St. Croix County Highway Department Star Prairie Maintenance Facility seconded by Trustee Marrier. Roll call vote, all members voted yes. Motion carried.

Open Session

Adjournment

Trustee Maxon moved to adjourn the meeting seconded by Trustee Berger. Motion carried. The meeting adjourned at 9:05 p.m.
