Pursuant to due call and notice thereof, amended agenda posted 12/2/2008, the Star Prairie Village Board met on 12/3/2008 at 6:30 p.m. in the Community Center. The meeting was called to order by President Greg Gibson. Roll call. Members Present: Trustees Rob Berger, Andrew Marrier, Bruce Johnson and President Greg Gibson. Trustee Mick Maxon arrived at 6:40 p.m. Also present attorney Tim Scott. Trustee Johnson moved to adopt the amended agenda as presented seconded by Trustee Marrier. Motion carried. Trustee Berger moved to approve the minutes of November 11, 2008 as presented seconded by Trustee Johnson. Motion carried. Trustee Berger moved to approve the October 2008 Treasurer's Report seconded by Trustee Marrier. Motion carried. Trustee Marrier moved to approve the disbursements ($27,667.82) as presented seconded by Trustee Berger. Roll call vote, all members voted yes. Motion carried.

PUBLIC HEARING

President Gibson asked for public comment on the 2009 Proposed Budget proposed by the Board and advertised in the paper for the residents of the Village. The revenues and expenditures proposed for 2009 are $509,120 (dollars) with a general property tax levy of $219,613 (dollars). The proposed Village mill rate is $5.74 (dollars) per thousand. No public comment was heard President Gibson closed the Public Hearing.

REPORTS

Police - Chief Richard submitted the November 2008 Police Activity report (on file).

Maintenance - Brody Larson presented the November 2008 Maintenance report (on file).

Park Committee - no report

NEW BUSINESS

Market Adjustment for 2009

Lisa Meyer, Assessor, was present to discuss the notification received from the Department of Revenue regarding the market adjustment for Village of Star Prairie for 2009 and presented an additional assessor bid that would include assessing all taxable property in the Village for 3 years, the first year being a market adjustment and the following 2 years of maintenance. The Board consensus was to stay with the June 4, 2008 accepted assessor proposal for the year 2009. No action taken.

Rural Mutual Insurance Company

Tom Jenkins, Rural Mutual Insurance Company agent gave an overview of the proposed Village of Star Prairie insurance coverage for 2009. Trustee Johnson moved to approve Rural Mutual Insurance Company proposal for 2009 seconded by Trustee Maxon. Roll call vote, all members voted yes. Motion carried.

2009 Budget, 2008 Tax Levy and 2009 Employee Wages

Trustee Marrier moved to adopt the 2009 Budget, 2008 Tax Levy and the 2009 Employee Wages as proposed seconded by Trustee Maxon. Roll call vote, all members voted yes. Motion carried.

Water System Improvements

Village engineer Jim DeBenedet, Stevens Engineers submitted water system improvements cost estimate for a second crossing of the Apple River for Village Board members to review. No action taken.

Proposed Amendment to Section 9-2-3(i) Maintenance of Services

Trustee Johnson moved to approve amending the Village of Star Prairie Ordinance Section 9-2-3(i) Maintenance of Services seconded by Trustee Berger. Roll call vote, all members voted yes. Motion carried.

SECTION I. SECTION AMENDED

Subparagraph "(i)," entitled "Maintenance of Services," of Section 9-2-3, entitled "User Rules," of Chapter 2, entitled "Sewer and Water Utility User Regulations," of Title 9, entitled "Public Utilities," of the Municipal Code of the Village of Star Prairie is hereby amended to read as follows [amended language is underlined; removed language is struck through]:

TITLE 9. PUBLIC UTILITIES

Chapter 2. Sewer and Water Utility User Regulation

Sec. 9-2-3. User Rules.

(i) Maintenance of Services.

(1) Water Services. All water and sewer services within the corporate limits of the Village from the street main to the location of the curb stop and including all controls between the same, will be maintained by the Systems Village without expenses to the property owner, except when they are damaged as a result of negligence or carelessness on the part of the property owner, or a tenant, or an agent of the owner, in which case they will be repaired at the expense of the property owner. All water and sewer services from the point of maintenance by the Village to and throughout the premises must be maintained free of defective conditions by and at the expense of the owner or occupant of the property. If the property owner does not repair an existing water leak between the curb stop and the building within twenty-four (24) hours, the water will be shut off and remain off until the repair is made completed to the satisfaction of the Village.

(2) Sewer Services. All sewer services within the corporate limits of the Village from and including the "Y" into the main to and throughout the premises must be maintained free of defective conditions by and at the expense of the owner or occupant of the property. All other sewer services within the Village will be maintained by the Village without expense to the property owner, except when they are damaged as a result of negligence or carelessness on the part of the property owner, or a tenant, or an agent of the owner, in which case they will be repaired at the expense of the property owner.

SECTION II. SEVERABILITY

If any provision of this Ordinance or any application of this Ordinance to any person or circumstance is found to be invalid or unconstitutional, such a finding shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid or unconstitutional provisions or applications.

SECTION III. EFFECTIVE DATE

This Ordinance shall take effect upon passage as provided by law.

Applications for Operator's License

Trustee Johnson moved to approve the Operator's Licenses for Joan Place and Michele Rivard for the Apple River Inn seconded by Trustee Maxon. Motion carried.

Set date for Village Caucus

Trustee Maxon moved to set the Village Caucus for January 7, 2009 at 6:45 p.m. prior to the Village Board meeting seconded by Trustee Marrier. Motion carried.

Counter Offer from St. Croix County

Trustee Johnson moved to approve the counter offer from St. Croix County for purchase of the St. Croix County Highway Department Property seconded by Trustee Berger. Roll call vote, all members voted yes. Motion carried.

Public Comment - none

Adjournment

Trustee Johnson moved to adjourn the meeting seconded by Trustee Maxon. Motion carried. The meeting adjourned at 7:20 p.m.
