Town Board Meeting Minutes
Wednesday, June 5, 2013
Chairman Schachtner called the meeting to order at 8:00 pm at the Town Hall. Present were Germain, Demulling, Plourde, Rauch and Schachtner. The Pledge of Allegiance was recited. No public input. Motion by Germain, seconded by Rauch to approve the agenda. Motion carried.
Clerk's/Treasurer's Report: Motion by Plourde, seconded by Demulling to approve the May 1st meeting minutes. Motion carried. Motion by Germain, seconded by Demulling to approve the May 20th special meeting minutes. Motion carried. Motion by Rauch, seconded by Plourde to approve the May Financial Report. Motion carried.
Parks & Rec Committee Report: Germain said committee suggested sign replacement at Parnell Prairie Preserve, Twin Springs and Pine Lake.
Building Inspector's Report: Motion by Demulling, seconded by Rauch to approve the May Building Inspector Report. Motion carried.
Animal Control Report: Motion by Germain, seconded by Plourde to approve the May Animal Control Report. Motion carried.
Fire/Rescue Commission Report:Plourde read Belisle's report consisting of 31 calls for May. 138 calls so far for 2013, compared with 127 calls the same time last year.Truck committee made a visit to Rosenbauer and recently put specs out for bid due by June 21st. Department is gearing up for Pea Soup Days and pancake breakfast. Motion by Rauch, seconded by Demulling to approve the May Fire/Rescue Commission Report. Motion carried.
Old Business - Set Date for July Board Meeting: Motion by Plourde, seconded by Germain to change the July 3rd Town Board meeting to Wednesday, July 10th at 8:00 p.m. Motion carried.
A & D Paving/Robert Goodman - Delinquent 2011 & 2012 Taxes: Schachtner stated the certified letter mailed last month was returned unclaimed, however, Goodman did make a $200.00 payment toward the 2011 delinquent personal property tax bill. Motion by Plourde, seconded by Demulling to have Schachtner make a final contact by phone to Goodman to submit both 2011 & 2012 delinquent personal property payments in full by July meeting or Town will proceed with small claims court filing. Motion carried.
New Business - Tim Lindquist/Chilakoot Bowhunters 60th Anniversary Shoot June 8 & 9 - Requst for Parking Vehicles on Town Road: Tim Lindquist requested permission to use 165th Avenue & 38th Street as overflow parking for the event. Lindquist said no parking signs would instruct parking on only one side of the road. (East side of 38th St. and South side of 165th Avenue). Lindquist would arrange to put up and take down the no parking signs. Motion by Plourde, seconded by Rauch to approve the parking request by Chilakoot Bowhunters for June 8 & 9 as stated above. Motion carried.
Planning Commission Report - Alba Murray/S & N Land Surveying - 1 Lot CSM: Motion by Demulling, seconded by Plourde to approve the 1 Lot CSM for Alba Murray. Motion carried. Park fee has been paid.
Tough Mudder Event - Memorandum of Understanding (Draft): Event dates: July 20 & 21. Adjacent landowners have already been notified and a sample has been provided to the Town for posting. Question and discussion of the bond-last year it was $20,000. Mithun stated that Tough Mudder has a contract with each individual landowner and is responsible for the restoration of the landowner's property. Schachtner stated the bond would protect the town from any other issues such as sanitation and enforcement. The restoration part of bond could be omitted in the requirement. Demulling questioned if course runs through any wetlands. Mithun stated it does not. Number of portable toilets was discussed and it was agreed upon that the number would be reduced to 20 from 32. In 2012, the agreement was for three St. Croix County Sheriff Officers and eight private, licensed security guards. Board consensus was that for 2013 there should be two St. Croix County Sheriff Officers and four private, licensed security guards with the times set as 7 am - 6 pm on Saturday and 7 am-3 pm on Sunday. A placement plan for security officers was required for 2012; no placement plan will be required for 2013. No parking barrels will still be required in the same locations as 2012. Plourde requested EJ L'Allier and Matt Mithun's cell phone numbers in case a need arises during the event. Memorandum of Understanding section 11.a. can be deleted; 11.b. bond required by Town could be decreased to $5,000; 11.c. lease agreements and liability insurance - copies to be provided to the Town remains. Schachtner stated an adjacent landowner has expressed a fence issue and the Town would like that area to have security or fence in place so it isn't breached. Mithun agreed. Rauch stated these changes will be made and the Memorandum of Understanding will be brought back to the June Planning Commission meeting for review and the July 10th Town Board meeting for final approval. Don Kern was present to discuss people cutting in through the back side of the property instead of along the main route. Last year, there was a person there to direct people who were trying to cut through the back. Mithun agreed he'd have someone there directing pedestrian traffic again. Amanda Engesether / Ellen Denzer - St. Croix County Community Development - Presentation on Draft Farmland Zoning Ordinance, Key Changes, Tax Credits, Timeline for Comprehensive Revision, Draft Zoning Districts, Questions & Answers: Amanda Engesether & Ellen Denzer from St. Croix Co. Community Development were present to give a detailed discussion on the Farmland Preservation Zoning Process, along with an opportunity for the public to ask questions. Schachtner thanked Denzer & Engesether for their time explaining this process.
Consider Approval of 2013-14 Renewal Licenses for Reserve Class B Liquor License, Class B Combination Liquor Licenses, Operator, Tobacco/Cigarette, Tubing/Camping, Concessions and Junkyard/Salvage yard & Fee for Reserve Class B License to Hideaway: Town Board reviewed the list of license renewals. No outstanding or delinquent bills to the Town. Discussion on fee for Reserve Class B License to Hideaway. Motion by Schachtner, seconded by Germain to approve the list of license renewals of tobacco/cigarette, tubing/camping, junk yard/salvage yard, concessions, operators and Class B Combination Retail Liquor Licenses to: Potting's Bar, The Settlement, T-Buckets Bar & Grill LLC, Phaneuf-Vanasse American Legion, St. Croix National Golf & Event Center and Reserve Class B Combination License to Hideaway LLC and to charge an annual fee to Hideaway of $550.00, prorating one month due to Reserve License being issued last month. All operator's license holders must have a Learn to Serve course certificate or have been an operator for the past two years. Motion carried.
Consideration of Reserve Class B Liquor License for Somerstar Entertainment LLC, Trade Name: Somerset Amphitheatre (EJ L'Allier agent) 1814 County Road I: Matt Mithun discussed plans for a vendor building in front of the main barn, accessed by campers to sell liquor. Portable toilets would be on site. Foot traffic only; although there is road access to County Road I for emergency access. Mithun requested consideration of the Reserve Class B Liquor License at the premise 1814 County Road I for the new vendor building. No plans to use the current barn. Property is currently zoned ag./residential. Mithun met with St. Croix County Community Development staff and they advised him that the property must be rezoned into Commercial and a Special Exception Permit issued for the change in use. Applications have been submitted to the county for the rezonement. 90 day open for business timeframe could be met; however, not this year if rezonement and special exception permit are granted late summer. Schachtner commented the Reserve License could be postponed until the commercial zoning is granted. Mithun stated since there is a finite amount of licenses available, he does not want them to be depleted while he is in the process of the rezonement and he does not want to rezone and purchase the property without the license. $10,000 fee has been submitted. After much discussion, motion by Rauch, seconded by Demulling to approve the issuance of the Reserve Class B Liquor License pending St. Croix County approves the property being rezoned into Commercial and a Special Exception Permit is granted. The license will be held until these approvals are granted and if not, granted, the license will not be issued. Motion carried.
Consideration of Renewal of Town Hall Use Contract for Somerset Senior Center: Motion by Plourde, seconded by Germain to approve the Town Hall Use Contract for the Somerset Senior Center as presented. Motion carried.
Elizabeth & Jeff Grigsby - Access to Landlocked Parcel WSS 82.27, Parcel #032-1048-10-100: Jeff & Elizabeth Grigsby discussed the history on the family owned parcel. In 1984, the Federal Government purchased 120 acres out of the 160 acres owned for the Scenic Riverway Act. The family split the remaining property into 4-10 acre parcels giving each sibling a parcel; two parcels do not have road access. In 2012, two siblings sold their parcels, leaving Grigsby without an access. Grigsby referenced WSS 82.27. Grigsby stated if access cannot be gained, he will ask for a lowering of his assessed value. Grigsby stated no neighbors are interested in selling or swapping land for an access. WSS 82.27 requires the laying out of a town road, not a driveway, and the road must be in the best interest of the public; it would also be very expensive to put in a road for so few of lots with park land never being subdivided. Discussion on the driveway permit that was issued to one of the front lots in December 2012. Rescinding the driveway permit, still would not grant the Grigsby parcel a legal access/easement to the back. Plourde commented that Grigsby should try to negotiate for an access with the adjacent landowners. No action taken.
Chamber of Commerce - Request for Pea Soup Days Donation & Membership - Combo Price $300.00: Motion by Plourde, seconded by Demulling to approve the Pea Soup Days Donation & Membership combination price of $300.00. Motion carried.
Mitigation Funds/Stillwater Bridge Update: Rauch reported on last meeting. Any interested landowner that wishes to submit for possible purchase of land due to Greenway Funding, forms available on St. Croix County's website. These forms will be viewed by committee in September. Final determinations and negotiations made by another smaller committee. Rauch asked Town Board to consider hiring West Central Regional Planning to help update the Comprehensive Plan. Consensus was to pursue getting prices.
Transportation & Facilities Committee Report - Roads: Motion by Demulling, seconded by Germain to approve the TRIP contract with WisDOT for partial funding of the Rice Lake Road project in 2013. Motion carried. Motion by Plourde, seconded by Germain to approve the St. Croix County Highway Dept. to bid and award the purchase of hot mix material used for the Rice Lake Road paving project on behalf of the Town of Somerset. Motion carried. Schachtner stated the county recommended an overlay of the section of Twin Springs Road that has deteriorated. Work to begin soon on 170th Avenue.
Consideration to Purchase a New Loader: Consensus was to look for a new loader with the warranty and municipal discount. Schachtner will get three prices from Cat, Case and John Deere for July meeting.
