AN ORDINANCE ANNEXING TERRITORY TO THE CITY OF NEW RICHMOND, WISCONSIN.

THE COMMON COUNCIL OF THE CITY OF NEW RICHMOND DOES ORDAIN AS FOLLOWS:

Section 1. Territory Annexed. The following described territory presently located in the Town of Star Prairie is hereby annexed to the City of New Richmond.

Territory described as follows: Lakeside Foods (North Parcel): Part of the Southeast Quarter of the Southwest Quarter (SE-SW), part of the Northeast Quarter of the Southwest Quarter (NE-SW), the Northwest Quarter of the Southeast Quarter (NW-SE), part of the Northeast Quarter of the Southeast Quarter (NE-SE) and part of the Southwest Quarter of the Southeast Quarter (SW-SE) of Section 34, Township 31 North, Range 18 West, Town of Star Prairie, St. Croix County, Wisconsin more particularly described as follows: Commencing at the East Quarter Corner of said Section 34, this also being the POINT OF BEGINNING of the parcel to be described;Thence, South 12 degrees 45 minutes 40 seconds West (Bearings referenced to the St. Croix County Coordinate System) 132.97 feet to a point on the west right of way line of County Highway “K”; Thence, continue South 12 degrees 45 minutes 40 seconds West on said west right of way line 73.53 feet; Thence, South 09 degrees 20 minutes 31 seconds West on said west right of way line 250.74 feet; Thence, South 01 degrees 33 minutes 55 seconds East on said west right of way line 400.49 feet to a point on the north right of way line of State Highway 64 as described in Volume 1553, Page 540; Thence, South 71 degrees 22 minutes 59 seconds West on said north right of way line 872.59 feet to a point of curvature; Thence, on the arc of a curve on said north right of way line 1502.56 feet, concave to the southeast, Central Angle 13 degrees 53 minutes 09 seconds, Radius 6199.86 feet, Chord Length 1498.88 feet, Chord Bearing South 64 degrees 26 minutes 25 seconds West to a point of non-tangency; Thence, North 32 degrees 30 minutes 05 seconds West on said north right of way line 30.00 feet; Thence, South 57 degrees 29 minutes 50 seconds West on said north right of way line 760.36 feet to a point of curvature; Thence, on an arc of a curve on said north right of way line 1027.31 feet, concave to the northwest, Central Angle 30 degrees 25 minutes 10 seconds, Radius 1934.95 feet, Chord Length 1015.28 feet, Chord Bearing South 72 degrees 42 minutes 25 seconds West to a point of non-tangency; Thence, South 00 degrees 27 minutes 03 seconds West on said north right of way line 23.13 feet to a point on a non-tangential curve; Thence, on an arc of a curve on said north right of way line 14.14 feet, concave to the northeast, Central Angle 00 degrees 49 minutes 22 seconds, Radius 984.98 feet, Chord Length 14.14 feet, Chord bearing North 89 degrees 08 minutes 20 seconds West to a point of non-tangency; Thence, North 00 degrees 23 minutes 35 seconds West on the west line of the east half of said Southwest Quarter 1610.26 feet; Thence, North 89 degrees 18 minutes 32 seconds East 462.00 feet (deed 28 rods); Thence, North 00 degrees 23 minutes 35 seconds West 561.00 feet (deed 34 rods); Thence, North 89 degrees 18 minutes 32 seconds East 429.00 feet (deed 26 rods); Thence, North 00 degrees 23 minutes 35 seconds West 264.00 feet (deed 16 rods) to a point on the East-West Quarter Line of said Section 34;Thence, North 89 degrees 18 minutes 32 seconds East on said East-West Quarter Line 3021.58 feet to the POINT OF BEGINNING and there terminating. Including road right of way for 185th Avenue and County Highway “K” this parcel contains 5,779,690 Square Feet (132.68 Acres). Excluding road right of way for 185th Avenue and County Highway “K” this parcel contains 5,671,850 Square feet (130.20 Acres).

Lakeside Foods (South Parcel): All that part of the Southeast Quarter (SE1/4) of Section 34, Township 31 North, Range 18 West, Town of Star Prairie, St. Croix County, Wisconsin more particularly described as follows: Commencing at the southeast corner of the Southeast Quarter (SE1/4) of said Section 34; Thence, West along the South line of said Southeast Quarter (SE1/4) a distance of 1894 feet 6 inches (measured 1894.32 feet); Thence North to the South right of way line of the Soo Line railroad tracks, as presently located in said Section 34; Thence, in a northeasterly direction along the South right of way of said Soo Line railroad tracks to the East line of the Southeast Quarter (SE1/4) of said Section 34; Thence, South along the East line of the Southeast Quarter (SE1/4) of said Section 34 to the POINT OF BEGINNING, except part deeded to the State of Wisconsin, Department of Transportation in Volume 1553, Page 540, Document No 632440. Containing 1,978,613 square feet (45.42 acres) including Right of Way, 1,871,345 square feet (42.96 acres) excluding Right of Way. Subject to all easements, restrictions and covenants of record.

Section 2. Effect of Annexation. From and after the date of this ordinance the territory described in Section 1 shall be a part of the City of New Richmond, for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of New Richmond.

Section 3. Temporary Zoning Classification. (a) Upon recommendation to the City Council of the City of New Richmond the territory described above, annexed to the City of New Richmond by this ordinance is designated as: North Parcel is designated as (I1) Light Industrial and the South Parcel is designated as (R-2) Single Family Residential - Small

(b) The boundaries of the annexed territory are established as shown on the map filed in the office of the City Clerk of the City of New Richmond.

Section 4. Ward Designation. The territory described in Section 1 of this ordinance is hereby designated as: The North parcel is part of Ward 1, Aldermanic District 1, and the South parcel is part of Ward 3, Aldermanic District 1, of the City of New Richmond.

Section 5. Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application.

Section 6. Effective Date. This ordinance shall take effect upon passage and publication as provided by law.
