AN ORDINANCE ANNEXING TERRITORY TO THE CITY OF NEW RICHMOND, WISCONSIN.

THE COMMON COUNCIL OF THE CITY OF NEW RICHMOND DOES ORDAIN AS FOLLOWS:

Section 1. Territory Annexed. The following described territory presently located in the Town of Richmond is hereby annexed to the City of New Richmond.

Territory described as follows:

A parcel of land located in the SW 1/4 of the SW 1/4 of Section 10, T30N, R18W, Town of Richmond, St. Croix County, Wisconsin. Said parcel described as follows: Commencing at the SW corner of said Section 10; thence N00?06’44”W (recorded as N00?06’47”W), 1106.93 feet along the west line of Section 10 to the point of beginning. Thence continuing N00?06’44”W along said west line, 200.00 feet to the SW corner of the Plat of Evergreen Valley III; thence S89?53’48”E, 1334.25 feet (recorded as S89?31’50”E, 1334.28 feet) along the south line of said Plat, also being the north line of the SW 1/4 of the SW 1/4 of Section 10; thence S00?00’28”E, 200.00 feet along the east line of said SW 1/4 of the SW 1/4 ; thence N89?53’48”W, 1333.88 feet to the west line of Section 10 and the point of beginning. This parcel is intended to be the North 200 feet of the SW 1/4 of the SW 1/4 of Section 10, T30N, R18W and contains 266,900 square feet, more or less (6.13 acres). (Property owned by Tamec)

Section 2. Effect of Annexation. From and after the date of this ordinance the territory described in Section 1 shall be a part of the City of New Richmond, for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of New Richmond.

Section 3. Temporary Zoning Classification. (a) Upon recommendation to the City Council of the City of New Richmond the territory described above, annexed to the City of New Richmond by this ordinance is designated:

Agriculture: A parcel of land located in the SW 1/4 of the SW 1/4 of Section 10, T30N, R18W, Town of Richmond, St. Croix County, Wisconsin. Said parcel described as follows:Commencing at the SW corner of said Section 10; thence N00?06’44”W (recorded as N00?06’47”W), 1106.93 feet along the west line of Section 10 to the point of beginning.Thence continuing N00?06’47”W along said west line, 100.00 feet to the SW corner of a proposed Certified Survey Map; thence S89?53’48”E, 435.00 feet along the south line of said map; thence N00?06’44”W, 80.00 feet along the east line of said proposed map; thence S89?53’48”E, 420.45 feet along the south line of said map to the east line of White Pine Way extended to the south; thence N00?34’26”W, 20.17 feet along said east line to the south line of the Plat of Evergreen Valley III; thence S89?52’34”E (recorded as S89?31’50”E), 478.97 feet along said south line to the SE corner of the Plat of Evergreen Valley; thence S00?00’28”E, 200.00 feet along the east line of the SW 1/4 of the SW 1/4 of Section 10, T30N, R18W; thence N89?53’48”W, 1333.88 feet, more or less, parallel with the north line of said SW 1/4 of the SW 1/4 to the west line of Section 10 and the point of beginning. Said parcel contains 214,950 square feet, more or less (4.93 acres).

(W) Conservation: A parcel of land located in the SW 1/4 of the SW 1/4 of Section 10, T30N, R18W, Town of Richmond, St. Croix County, Wisconsin. Said parcel described as follows:

Commencing at the SW corner of said Section 10; thence N00?06’44”W, 1306.93 feet along the west line of Section 10 to the point of beginning. Said point also being the SW corner of Outlot 15 of the Plat of Evergreen Valley III; Thence S89?54’44”E, 795.28 feet along the south line of said plat; thence continuing along said south line S89?51’11”E, 60.01 feet to the east line of White Pine Way extended to the south; thence S00?34’26”E, 20.17 feet along said extension; thence N89?53’48”W, 420.45 feet; thence S00?06’44”E, 80.00 feet; thence N89?53’48”W, 435.00 feet to the west line of Section 10, T30N, R18W; thence N00?06’44”W, 100.00 feet to the point of beginning. Said parcel contains 51,950 square feet, more or less (1.19 acres).

The boundaries of the annexed territory are established as shown on the map filed in the office of the City Clerk of the City of New Richmond.

Section 4. Ward Designation. The territory described in Section 1 of this ordinance is hereby designated as part of Ward 11, Aldermanic District 6, of the City of New Richmond.

Section 5. Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application.

Section 6. Effective Date. This ordinance shall take effect upon passage and publication as provided by law.

I, Joseph Bjelland, Clerk of the City of New Richmond, Wisconsin, do hereby certify that the foregoing is a correct copy of an Ordinance introduced at a regular meeting of the Common Council of the City of New Richmond on October 13, 2008 adopted by more than two-thirds vote, and recorded in the minutes of said meeting.
