PUBLIC NOTICE OF INTENT TO REISSUE A WISCONSIN POLLUTANT DISCHARGE ELIMINATION SYSTEM (WPDES) PERMIT No.WI-0002836-08-0

Facility Where Discharge Occurs: Lakeside Foods, Inc., New Richmond, 660 North 2nd St.

Receiving Water and Location: the Willow River and the groundwaters of the Lower Willow River Watershed of the St. Croix River Basin located in St. Croix County.

Brief Facility Description and Summary of Proposed Changes: The Lakeside Foods, Inc. - New Richmond Plant washes, processes and cans beans, corn, beets, carrots and potatoes. Cooling water is discharged to a cooling/seepage pond seasonally from May-November that overflows into the Willow River in St. Croix County and averaged 0.150 million gallons per day from 2005-2009. The wastewater consists of a combination of can cooling water and non-contact cooling water. This facility has groundwater discharges in the form of landspreading and spray irrigation. By-product solids (approximately 20,000-30,000 tons/year) is landspread on Department-approved sites. Spray irrigation wastewater is the product of vegetable washwater, blanching water, boiler blowdown, meuret system water, and equipment & floor clean-up water. Spray irrigation occurs at one of the following four sites: 1) ASP Site, located in the Town of Star Prairie 2) Zimmerman site, located in the Town of Star Prairie, 3) the Plant site, adjacent to and west of the facility, or 4) the Casey site, located in the Town of Star Prairie. A series of groundwater monitoring wells are set up around these four sites to monitor for groundwater impacts. Sanitary wastewaters and water softener regeneration brines are treated at the City of New Richmond Wastewater Treatment Facility. No major operational changes occurred in the last permit term. However, on December 18, 2008 Lakeside Foods received DNR approval to develop a 152 acre sprayfield in Stanton Township. This permit does not provide coverage for construction or operation of this proposed sprayfield but Lakeside Foods may reconsider development of this site at some point in the future. Significant monitoring and/or limitation changes proposed for the upcoming permit term are as follows: 1) Addition of seasonal weekly average effluent temperature limits (and an associated compliance schedule), 2) addition of an effluent phosphorus limit and an associated compliance schedule, and 3) changes in some of the groundwater PALs and ESs including changes in the alternate concentration limit for nitrate + nitrite nitrogen in most of the monitoring wells, removal of the BOD5 PAL & monitoring requirement, and a reduction in the PAL & ES for ammonia nitrogen at all of the wells.

The Department has tentatively decided that the above specified WPDES permit should be reissued.

Limitations and conditions which the Department believes adequately protect the receiving water are included in the proposed permit. Land application of waste shall be done in accordance with permit conditions and applicable codes. All land application sites shall be approved prior to their use. To receive a list of approved sites, or to be notified of potential approvals, contact the basin engineer.

Persons wishing to comment on or object to the proposed permit action, or to request a public hearing, may write to the Department of Natural Resources at the permit drafter’s address. All comments or suggestions received no later than 30 days after the publication date of this public notice will be considered along with other information on file in making a final decision regarding the permit. Anyone providing comments in response to this public notice will receive a notification of the Department’s final decision when the permit is issued. Where designated as a reviewable surface water discharge permit, the U.S. Environmental Protection Agency is allowed up to 90 days to submit comments or objections regarding this permit determination. If no comments are received on the proposed permit from anyone, including U.S. EPA, the permit will be issued as proposed.

The Department may schedule a public informational hearing if requested by any person and shall schedule a public informational hearing if a petition requesting a hearing is received from 5 or more persons or if response to this notice indicates significant public interest pursuant to s. 283.49, Stats. Requests for a public informational hearing shall state the following: the name and address of the person(s) requesting the hearing; the interest in the proposed permit of the person(s) requesting the hearing; the reasons for the request; and the issues proposed to be considered at the hearing.

Information on file for this permit action, including the draft permit and permit information form (PIF) may be inspected and copied at the permit drafter’s or basin engineer’s office, Monday through Friday (except holidays), between 9:00 a.m. and 3:30 p.m. Please call the permit drafter or basin engineer for directions to their office location, if necessary.
