Notice of Passage of an Ordinance Establishing a Moratorium
on the Expansion and Creation of New Nonmetallic
Mining Operations
Notice is Hereby Given that at its December 4, 2012, Town of Star Prairie Board Meeting, the Town Board adopted Ordinance 2012-4. This ordinance establishes a temporary moratorium on the creation of new or the expansion of existing nonmetallic mining operations in the Town. The moratorium was passed to give the Town Board sufficient time to study and consider the potential impacts on town infrastructure which would result from such operations, the adequacy of existing town regulations to address such operations, and the potential negative consequences of such operations to the environment and to surrounding property owners and to town residents generally. The moratorium is for a period of one year and provides that the Town Board and the Town Plan Commission will study the issues identified above and report on any recommended actions which should be taken to minimize any potential negative impacts. The ordinance contains definitions clarifying its application and contains a procedure through which a property owner can apply for exemption from its terms. Finally, it provides a penalty for violations of its terms.
