Town Board Meeting Minutes
Wednesday, January 4, 2017
(Not official until approved at next meeting.)
Chairman Schachtner called the meeting to order at 8:00 p.m. Present were Rauch, Germain, Demulling, Plourde and Schachtner. Motion by Germain, seconded by Plourde to approve the agenda. Motion carried. The Pledge of Allegiance was recited. Schachtner announced the meeting was being recorded.
Public Input: The following public comments on the agenda item for Chris Marshall/Kippes Family to rezone 22.34 acres from rural residential to commercial are entered into the record:
* Rick Randall residing at 683-200th Avenue stated his concern with the rezoning and was wondering if there were any plans for groundwater and keeping nitrates down. Randall stated concern with hazardous materials and noise pollution.
* Lloyd Peterson, 641-205th Avenue. Four objections to rezoning-traffic (blind hills on 205th Ave.), no environmental analysis yet, this is in his backyard and it is not what he wants and feels it will lower his property values, putting commercial in the middle of a residential area.
* Robert Bambach, 2180-59th Street, opposed to rezoning. Road traffic, noise, use of the facility/nature of use, groundwater contamination, taxes-does it alleviate taxes on other properties, is there any tax relief from the local government, potential expansion, clean air act.
* Matt Foucault, 2108-54th Street, stated he is against the zoning change. Wants it to remain residential property. Roads in the area arent wide enough for commercial traffic.
* Wade Skramstad, 679-205th Avenue, concern with traffic and blind hills. Rezone piece of property in the middle of a residential area does not make sense. Landowners do not want to see their property values go down.
Shelly Campeau, 664-200th Avenue, stated she is opposed to the rezoning.
Amye Rondeau, 677-207th Avenue, stated her property faces the sight and wants to maintain the rural, open spaces in the community.
Brian Wisniewski, 674-200th Avenue, opposed and stated online petition was signed and emailed.
Charles Mullan, 652-200th Avenue, property runs up to his land. Mullan stated he is against the rezoning. Too much traffic, concerned about wells, wants it moved someplace else.
Kevin Noeldner, 684-207th Avenue, no additional points to make just wants it on the record, he is opposed.
Ray Zilge, 670-200th Avenue, lives on a hill and the property considered for rezoning is right behind his house. He is opposed to the commercial rezoning, the well water and breathing the smoke.
Jennifer Erickson, 668-207th Avenue, opposed as she wants it to remain country not commercial.
Jeff & Teresa DeGeest, 692-207th Avenue, moved here recently; does not want construction going on and wants it to remain residential.
Rachel Harles, 674-207th Avenue, opposed.
Katherine Skramstad, 679-205th Avenue, opposed to the rezoning because the last commercial establishment off of 200th Avenue took down a hill and the herds of deer do not come through their property anymore. The wildlife is important and it needs to be protected.
Paul Vielhaber, non-resident, stated he felt it was a detriment to all in the room and only benefits one property owner.
The following public comments were in regard to requests for paving Heron Lane:
Kris & Sarah Kielsa, 1532 Heron Lane, requested the Town Board to consider paving Heron Lane.
David Lindstrom, 1527 Heron Lane, also requested consideration of paving Heron Lane this year.
Clerks & Treasurers Report: Motion by Plourde, seconded by Rauch to approve the December 7th meeting minutes. Motion carried. Motion by Demulling, seconded by Germain to approve the December financial report as presented. Motion carried.
Building Inspector Report: Motion by Rauch, seconded by Plourde to approve the December Building Inspector report as provided. Motion carried.
Animal Control Report: No calls for December.
Fire/Rescue Commission Report: Plourde read Belisles December report consisting of 22 calls for service. The total calls are 363 for 2016 compared with 406 for the same time in 2015. Structure fires appear to be on the rise. 2017 has started the year averaging more than 1 call per day. Motion by Demulling, seconded by Germain to approve the Fire/Rescue Commission report. Motion carried.
Parks, Rec & Planning Commission Report - Steve Guckenberger, 2371-53rd St. Request for Waiver to Reduce Setback from 100 to 50 to Construct a Pole Shed: Motion by Germain, seconded by Rauch to recommend to St. Croix County to approve the waiver to reduce the setback from 100 to 50 for Steve Guckenberger at 2371-53rd Street. Motion carried.
Dan & Jennifer Baillargeon/ James Rusch Surveyor - 1 Lot CSM and Road Easement Upgrade Agreement for 7.406 Acre Lot off 155th Ave.: Demulling concerned about a maintenance agreement for the shared driveways future use - discussion. Motion by Plourde, seconded by Germain to approve the 1 lot CSM 7.406 acres off 155th Avenue for Dan & Jennifer Baillargeon and the road easement upgrade agreement which must be recorded with the CSM. Motion carried. Park fee has been paid
Chris Marshall & Kippes Family/Request to Rezone Lot 1, 22.34 Acres from Rural Residential to Commercial off 68th Street (CME Business Park): Chris Marshall stated the facility will not accept asbestos or hazardous waste. The proposed facility is to help the community and he sees it as an asset to accept public appliances, e-waste and compost. Marshall stated he has four children in the community and wants to pass something on to them. The facility will contain and house everything in a proper fashion through the DNR and St. Croix Countys requirements. A Conditional Use Permit would have to be obtained. Marshall has had conversations with St. Croix County on the recycling program that is currently held twice a year in the county, along with the problem of dumping in roadways. Marshall stated he would like to come up with a facility that disposes of these items properly for a fee. Marshall added, compost materials would be stored outside and would be available for purchase. Marshall said he would look into the dust issue. Trees would be plated and/or berms/landscape to necessitate the aesthetics, community and professionalism. Schachtner stated the request on the agenda tonight is for the rezoning from rural residential to commercial. The Conditional Use Permit would come after the rezoning, defining the specific details of the use of any commercial business.
Much discussion on the Town of Somersets Comprehensive Land Use Plan adopted March 2015, the future land use map and proposed commercial node(s), the public opinion survey that was mailed in April 2014, and 200th Avenue road width and traffic volume.
Demulling asked if the residents in attendance would be opposed to a residential development going on the property. The majority indicated no opposition to residential development. Demulling asked if the biggest concern was Marshalls business or any business. Residents overwhelmingly responded that they wanted no commercial business. Plourde concerned about the actual size of the parcel at 22 acres. Discussion on a smaller parcel, splitting the parcel down and zoning only a part of it to commercial. Traffic volume, width of 200th Avenue along with intersection at Hwy. 35 and safety concerns are an issue. Consensus was 200th Avenue cant take the additional traffic. Motion by Demulling, seconded by Germain to deny the request to rezone the 22.34 acres off 68th Street due to the public input being against the rezoning, the narrow condition of 200th Avenue not being able to handle the additional traffic and the large size of the parcel requesting to be rezoned to commercial. Roll call vote: Rauch-yes, Demulling-yes, Schachtner-yes, Germain-yes, Plourde-yes to deny unanimously. Motion carried.
